NAME CHANGE DURING A PRO SE DIVORCE IN MICHIGAN

Michigan law allows a court to change a spouse's last name during the regular divorce process. A last name can be either restored to a birth name; or restored to the last name held prior to the marriage being dissolved; or another last name, so long as the change is not sought with any โ€œfraudulent or evil intent.โ€ [Michigan Compiled Laws, Chapter 552. Divorce ยง 552.391]. When doing your own divorce, this is clearly your best option if a name change is even a consideration. Changing you name post divorce is a much longer tedious filing process.

Many wive's assume their husbandโ€™s last name when they marry. When they divorce, most want to restore their maiden name. There are two options: they can either change their name back to a maiden (or any other name) or they can keep their soon-to-be-ex husbandโ€™s name. Contrary to what some people say, a spouse cannot be forced to change a name.

A spouse who wants to change his or her last name should state that in the Complaint for Divorce. Thatโ€™s it. There is no charge or extra steps to take when the name change is in the original Complaint for Divorce.

Changing a name after a divorce is final takes longer and costs more. The petitioner must file a new complaint for a name change, which costs more money, and have fingerprints taken and have the state police check for a criminal record. In addition, the petitioner must publish a document in the legal news and go before the judge to have the change approved.

After any name change the spouse should notify the United States Social Security Administration and the Michigan Secretary of State to get his or her restore name actively in use.
