MINNESOTA DIVORCE HEARINGS AND COURT APPEARANCES

Minnesota is a no-fault only state where dissolutions are filed the County or District Court. Generally, uncontested dissolutions in Minnesota move through the court in one of two ways: with a default by the respondent after 30 days of receiving the divorce papers, or an agreement between the parties that is memorialized in a stipulation (or a marital termination agreement). In each case, the action may move to a hearing as it is always up to the judge. If the parties have minor children together, the spouse who files the divorce will most likely attend a hearing in order to finalize the divorce. If there are no children, in most cases, no hearing is required, and the respondent need not attend this hearing. If the petitioner must appear, he or she is sworn under oath and testifies to all the facts necessary for the court to order the relief requested in the petition or stipulation. In most cases the hearing is very short and simple. Most of the questions can be answered yes or no and the judge signs the Finding of Fact, Conclusions of Law, Order for Judgment and Judgment and Decree.

In some cases, there will be a temporary relief hearing that takes place after the divorce papers are served. This is most common with a contested divorce where temporary support orders and issues regarding the children must be put in place because the process of finalizing the dissolution takes much longer. At the hearing the court makes an order that sets the rules for the parties until the divorce is final. A temporary relief hearing is especially important if children are involved and there is disagreement over custody, or if child support needs to be decided right away.

If the petitioner files for a simplified Summary Dissolution in Minnesota, a court hearing will not take place. In the case of a Joint Dissolution and no minor children, the court administrator places the case on the default calendar for approval without hearing.
