ILLINOIS DIVORCE HEARINGS AND COURT APPEARANCES

In Illinois, in an uncontested divorce only the spouse who initiated the divorce typically needs appear at the hearing, as long as the other spouse signs all necessary documents. In rare circumstances both spouses are requested to attend. The petitioner testifies about the particulars of the marriage -- the grounds of the divorce and the terms of the agreement. The Illinois divorce court appearance is usually a brief formality. The appearance places the Marital Settlement Agreement on the record and established that the agreement was entered into willingly. Once the judge is satisfied, he or she approves the divorce by signing the Judgment for Dissolution of Marriage which incorporates the Marital Settlement Agreement. The final hearing normally takes between five to ten minutes.

Depending upon the issues resolved in the Agreement, the judge may have questions or require additional information, so that one spouse, and sometimes both spouses, may want to consider attending the hearing.

Contested divorce actions become much more complicated and slower moving because they involve pretrial conferences, where each party presents its side of the argument, and discovery, where both sides learn each otherโ€™s financial position.
