CONSIDERING GETTING A DIVORCE IN IDAHO?

In Idaho, when you decide your marriage is irretrievably broken, filing for a no-fault divorce puts you on the fast track to ending it. In Idaho, the filing spouse must live in the state for only at least six weeks (which is one of the shortest residency requirements in the United States), and only a minimum of 20 days must pass from the time of filing for a divorce to be finalized. These parameters are among the most generous in the United States. Naturally, you want to consider all the issues before you decide whether you want to hire a lawyer to handle the divorce or do it yourself. If you and your spouse can work together, you may be able to file a Pro Se divorce (a divorce without a lawyer) and save a lot of money on legal fees.

Advantages of Doing Your Own Divorce in Idaho

Pro Se divorce litigation means you are representing yourself in your divorce case, without hiring a lawyer. Under this circumstance you are proceeding without legal representation. With or without legal representation however, the procedures that you follow are very much the same. The required divorce papers must be completed and signed and file with the Clerk of the Court. 3StepDivorceTM for Idaho, like other do-it-yourself solutions, it is streamlined to make preparing your own divorce papers extremely easy, which is why a very large percentage of uncontested divorces are filing Pro Se through the Idaho court system.

There are often the legal as well as emotional aspects when a couple decide to divorce. If you and your spouse cannot keep the emotions out of the negotiation process, you should at least consider consulting with a lawyer to find out what your rights and responsibilities would be in the divorce action. You want to try and prevent your uncontested divorce from becoming contested.

1. Cost. A contested divorce in Idaho can cost thousands for each spouse consisting of mostly lawyer fees. A lawyer may charge about $200 per hour on average. Even when you are filing an uncontested divorce and hire a lawyer, you are going to have fees between $1,500 to $3,000 depending on the metro area and your unique situation (for example most lawyers charge more is you have minor children or a sizable marital estate). In Idaho the cost of a Pro Se divorce is the filing fees, which is $207 and any fees associated with preparing your forms and Marital Settlement Agreement (MSA). Your total cost with 3StepDivorceTM will be about $506, about half or less than what you would spend if you hired a lawyer.

2. Control. Filing Pro Se puts you and your spouse at the forefront of your own negotiation of a fair settlement. If you reach an agreement on the terms and conditions of the divorce, you can file a settlement agreement with the court before the case proceeds to the hearing stage. This is ideal for Pro Se filers and is way to control the outcome and the time it takes to finalize your divorce.

3. Ease. Filing for divorce in Idaho is very easy. The filing spouse must live in the state for at least six weeks. Finalizing a divorce is just as easy because Idaho requires a minimum of 20 days to pass from the time of filing for a divorce to be finalized.

Deciding to Hire a Lawyer for Your Divorce in Idaho

Often couples cannot agree on the terms of the divorce, a fair settlement. If emotions run high, the likelihood of an amicable divorce decreases and the best course may mean hiring an experienced lawyer who will advise you of your legal rights and responsibilities. A lawyer is an unbiased third party who can help you negotiate the issues holding you back from an unfair settlement.

One of the best ways to find a lawyer is the word-of-mouth recommendation of a trusted friend or family member who has had experience with divorce.
