NAME CHANGE DURING A PRO SE DIVORCE IN NEW YORK

When filing your own divorce in New York it is recommended to take care of any name changes that are desired by the plaintiff and/or defendant within the actual divorce papers rather than doing it after the divorce is finalized. The reasoning is because it is a much easier and a less costly process to handle it as part of the divorce versus filing a separate request with the court, which actually has its own Index Number with the court. Since reverting back to prior or maiden names is so common at the time of a divorce, the state of New York (as well as many other states) have integrated it into the actual divorce proceedings. This has helped streamline the process and eliminate court costs.

In New York, in the Complaint for Divorce the plaintiff or defendant can ask to restore any name used before the marriage, Thus, any name combinations that include a spouseโ€™s last name; any former name of either spouse; a new name combining into a single name all or a part of either spousesโ€™ present or former last names; a hyphenated name consisting of any combination or either spousesโ€™ last name or former last names. The requested name change is finalized as part of the divorce as long as it is requested and orders in the Judgment of Divorce.

To get a legal name change after divorce in New York, the plaintiff or the defendant needs a certified copy of his or her Judgment of Divorce; proof of identification, which means a driver's license, state ID, or passport; and proof of age, which means an adoption decree, hospital record, or birth certificate.

An adult can change his or her name when he or she gets married or divorced, but a child's name does not change when a parents name is changed when married or divorced.
