NAME CHANGE DURING A PRO SE DIVORCE IN FLORIDA

When doing your own divorce in Florida it is best to take advantage of the opportunity to do a name change as part of the divorce paperwork. A wife ending her marriage in Florida can change her name during the divorce without the added cost of making the request in a separate Name Change Petition.

A paragraph on the Florida Petition for Dissolution Marriage addresses restoring the wifeโ€™s name. The section reads: โ€œWife requests to be known by her former name, which was ________[full legal name]__________โ€ The woman enters the name she wants to use after divorce in the blank at the end of the name change paragraph, and she enters the name she wishes to use in the "Request" section at the end of the Petition. Next, the wife takes the original copy or a certified copy of the signed Final Judgment of Dissolution of Marriage to the local Social Security Administration and the original copy or a certified copy to the Florida Department of Highway Safety and Motor Vehicles. to update a driver's license or state ID. It is best to take care of the Social Security Card first, because a current version with the new name is required to get a new driver's license or state ID.

There is also an option to pay $50 to petition the court to reopen the divorce case fro a name change, but it is subject to a judge's discretion whether or not the petition is recognized or granted.
