Getting Started With the Correct Divorce Papers

To begin an uncontested divorce in South Carolina, the plaintiff, who is the party initiating the action, completes the following forms:

An indigent plaintiff may file a Motion and Affidavit to Proceed In Formis Puperis (SCCA 405F) to the signed and notarized Financial Declaration. The court may exempt the party from the court filing fee.

After making two copies of each document, the plaintiff files the divorce papers with the clerk of the court, Family Court Division, and pays the $150 filing fee (which may vary by county). The clerk time and date stamps the required divorce papers and assigns a unique case number to the paperwork. The clerk keeps the original for the court and returns the copies to the plaintiff who serves one copy of each paper to the defendant in what is called service of process.

Serving the Divorce Papers

The plaintiff serves the initial divorce papers -- the Family Court Cover Sheet, the Certificate of Exemption, the Summons for Divorce, the Complaint for Divorce, and the Financial Declaration form – in one of five ways:

Personal service, where the defendant signs the Acceptance of Service within 35 days puts the action right on track because the plaintiff can file a Request for Hearing (SCCA 400.10 SRL-DIV). This is the most common solution for service for those couples that are cooperating and filing their own uncontested divorce.

In turn, the court clerk mails the plaintiff a Notice of Hearing, and the plaintiff must provide the defendant a copy of the notice 10 days before the hearing is scheduled. After mailing the notice to the defendant, the plaintiff must complete an Affidavit of Service by Mailing (Notice of Hearing) (SCCA 400.09 SRL-DIV), which must be signed and witnessed by a notary. In preparation for the hearing, the plaintiff prepares the Final Decree of Divorce and a completed Report of Divorce or Annulment of Marriage (DHEC Form 0682), which a one-page record of the case. The court may also ask the plaintiff to complete a SCRCP Form 4F, which is the Judgment of the Family Court. The judge signs the Final Decree of Divorce and the Form 4-F, which are filed with the clerk of the Courts. The spouses are divorced when they receive a clocked copy of the Final Decree of Divorce from the Clerk of Courts.
