HOW TO FILE COLORADO UNCONTESTED DIVORCE PAPERS

In Colorado the Rockies make for a tough climb, but the road to an uncontested, no-fault divorce can be straight, smooth and easy. To start a Colorado divorce, either spouse must live in the state for 91 days and the action is typically filled in the county where either spouse resides.

Filing for Divorce as Co-Petitioners

A couple can make their divorce very easy when they agree to signing the Petition for Dissolution of Marriage in an agreeable fashion as co-petitioners. In this routine, they file the Petition, form JDF 1101, and a Case Information Sheet, form 1101, which provides a profile of the parties and the minor children (if any). This step eliminates the need for formally serving a summons since both parties already know that the divorce action has been started and it is uncontested.

Filing for Divorce as Petitioner and Respondent

If co-petitioner is not your option, the respondent can still agree to the divorce and the petitioner can file by him or herself when he or she knows the location of the other respondent. When the respondent agrees, he or she signs the Waiver and Acceptance of Service and waives formal service of process. Signing the Waiver and Acceptance of Service moves the divorce along through the court. Signing the Waiver and Acceptance means the respondent waives formal service, but does not always mean that he or she is in agreement with the truth of the allegations in the Petition.

If the Respondent does not sign the Waiver and Acceptance of Service, he or she must be served formally by a disinterested person over 18 who serves all the copies of the divorce paperwork on the respondent. This requires a Proof of Service, which is a notarized Return of Service to the court. This proves to the court that the respondent is aware of the divorce proceeding.

After the respondent files an answer, either party may request a status conference by filing a Notice to Set Status Conference or Request for Status Conference, which determines the movement of the case. The court set hearing dates. Most courts set this conference 40 days after the filing. The Case Management Order details the trajectory of the case.

At a minimum the court requires

Ninety days from filing of the Petition fro Dissolution of Marriage or of service, whichever occurs later, a Decree of Dissolution of Marriage and Child Support Order may be granted when the spouses agree on all issues.
