This summary is written to give you a brief overview of the process and time-line.

In Arizona, like many jurisdictions, the respondent can accept the Petition for Dissolution of Marriage and other divorce papers by signing an Acceptance and Waiver of Service, which abbreviates formal service of process. Signing the waiver signals that the respondent is aware of the divorce and agrees with the divorce, and it expedites the movement of an uncontested divorce through the court.

When the spouses agree to divorce, the divorce can be made final in as few as 60 days.

The Waiver of Service is among the Arizona divorce papers which also include:

In the case of minor children, when the petitioner files the divorce action, the court routinely issues a standing order, a Preliminary Injunction Against Both Petitioner and Respondent (DR14F), which enjoins either of them from dissipating marital assets, harassment and removal of the children without mutual consent. Parents with minor children receive the Order and Notice to Attend Parent Information/Education Program Class as well which is a requirement in most counties.

In signing the waiver, the Respondent in Arizona retains the right to file a response within 20 days or 30 days (when he or she is outside of Arizona). He or she also certifies that he or she is not in the military, or if he or she is waives any protection from civil litigation under the Service Members Civil Relief Act.

In addition to the above forms, the petitioner prepares a one-page form entitled the Family Court/Sensitive Data Coversheet. It is a one-page summary of the case that gives basic information about the spouses, their children and profiles their finances. This form goes to the court and is used for easy reference in the case file.

Filing and Finalizing an Arizona Divorce

The petitioner organizes the forms in three sets: all of the originals described above, to the court; copies of everything (except the Family Court/Sensitive Data), to the spouse; and a set for him or her to keep.

Arizona offers what is known as a covenant marriage, which carries with it more demanding protocols for a divorce. An estimated 0.25 percent to 1 percent of new marriages are covenant, so this type of divorce is not very common.

The only grounds for divorce in a non-covenant marriage are no-fault, which means that the marriage is irretrievably broken. At the final hearing, the judge reviews the case, the filing, and if convinced that the marriage is irretrievably broken, grants the divorce by signing the Final Decree of Dissolution of Marriage.
