Louisiana Residency Requirements
The state of Louisiana has unique residency requirements for people who wish to terminate their marriage. You must meet these state-specific requirements prior to filing with your local parish court. The Louisiana residency requirements are as follows:
The filing spouse must be a resident for at least 12 months prior to filing. The divorce shall be filed in the parish in which either spouse resides.
Except in the case of a covenant marriage, a divorce shall be granted upon motion of a spouse when either spouse has filed a petition for divorce and upon proof that one hundred eighty days have elapsed from the service of the petition.
The Dissolution of Marriage is typically filed with in parish in which the filing spouse lives.

If you DO NOT meet at least one of the above residency requirements, you have the following options:
- Establish residency in Louisiana for the period time set forth above (this does not mean you have to wait to begin the process of getting your documents).
- Have your spouse do the filing if he or she meets the Louisiana residency requirements.
- Choose another state in which you or your spouse meet the requirements (all states are unique, so be sure to check the state in which you were married as an option).
